Delivery Terms and Conditions
  1. Deliveries are to mainland UK only – extra postal charges will apply to Isle of Wight, Isle of Man, Northern Ireland and the Scottish Isles.
  2. The customer is under a duty to inspect the goods on delivery and provide a signature.
  3. Deliveries are usually made on working days between 9am and 5pm Monday-Friday and will be delivered to the address shown on your order unless otherwise specified.
  4. No liability is accepted for any loss arising from delay in delivery of goods. The delivery date will not be the essence of the contract. When delivery depends upon receipt of the goods from the maker, we do not accept responsibility for delay in such delivery but we will afford to the customer any remedy available to us against the maker but this shall be the limit of our liability.
  5. We accept no responsibility for delay or non-delivery due directly or indirectly to strike, fire, act of state, force majeure or other unusual circumstances beyond our control.
  6. If the customer wishes to claim that there is any shortage on delivery in respect of goods supplied by us, that the same have been damaged in transit or that any goods supplied by us are defective or not in accordance with the contract, he shall give notice to us in writing and (in the case of any shortage or damage in transit) to any carrier by whom the goods were delivered within a day after the date of delivery of the same. If the customer fails to give such notice or fails to give us the opportunity to inspect the entire consignment, the goods shall be deemed to have been delivered and to be in accordance with the contract in all respects.
  7. Save as herein appearing, goods supplied will be replaced or repaired free of charge or in our absolute discretion the purchase price refunded if notice of the defect is given to us within 48 hours of delivery of the goods and are returned to our depot carriage paid and we are satisfied that they were defective in materials or workmanship on delivery. Claims for damages and or shortages made after 48 hours of your delivery arriving will be refused – the time and date of delivery is recorded with our carriers. Goods must be returned to the supplier at the buyers expense within 7 working days from receipt. Keep all packing materials in case you need to return the goods to us. The seller reserves the right to refuse a refund if the goods have been used, and/or the buyer has not informed Home Lighting UK Ltd by e-mail of the returning goods, and/or the goods are returned without the original packaging, and/or there are missing parts and/or the returns are not received within 7 days of receipt of the goods. A refund (including postage) except for returning postage charges will be given.
  8. We accept no liability for the cost of taking out, re-fixing or making good other materials. Subject to the above our entire obligation and the customers sole remedies shall be in respect of:
    1. Death or personal injury resulting from the manufacturers negligence.
    2. Direct physical damage to customers tangible property caused by the manufacturers negligence.
    3. Total liability for all loss or damage which is claimed to result from any breach of our obligations hereunder shall be limited to the customers actual money damages which shall not exceed the contract price for the goods (provided that the monetary limit shall not apply to liability for death or personal injury under (a) above).
    4. In no event shall we be liable for the loss or damage set out below even if foreseeable by us or in our contemplation:
      1. economic loss including loss of profits, business revenue, goodwill or anticipated savings,
      2. damages in respect of special, indirect or consequential loss or damage,
      3. any claim made against the customer by any other party
  9. If you fail to take delivery because you have cancelled the order under the Distant Selling Regulations the supplier shall refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods, less any expenses incurred for failed delivery.
  10. Delivery is entirely dependant on the buyers cleared funds without any deductions to the price displayed on our website.
